Nanawagan sa Senado at sa Department of Environment and Natural Resources (DENR) ang isang environmental group na agad imbestigahan ang operasyon ng Wacuman Sanitary Landfill sa Norzagaray, Bulacan dahil sa matinding paglabag sa iba’t-ibang batas at pagiging banta sa kalusugan.
Naaalarma na kasi ang Alliance for Consumer and Protection of Environment (ACAPE) — sa pamumuno ng kanilang taga-Pangulo na si Jun Braga — sa iregularidad ng Wacuman Sanitary Landfill dahil sa hindi nito pagtalima sa national at local environmental laws.
Sa kanilang liham sa tanggapan ni Senator Cynthia Villar, chairperson ng Senate Committee on Environment and Natural Resources; Senator Bong Go, Chairperson of the Senate Committee on Health at DENR Secretary Roy Cimatu, hiniling ng ACAPE ang kanilang tulong para tugunan ang samut’-saring isyu na may kinalaman sa Wacuman Sanitary Landfill.
Ayon sa grupo: “We are requesting your good office to look into the irregularities and violations of the Wacuman Sanitary Landfill located in Norzagaray, Bulacan which directly harms both the environment and the community.”
Ipinaliwanag ng ACAPE na hindi nag-apply ng permits to operate ang Wacuman Sanitary Landfill mula sa mga lokal na pamahalaan ng San Jose del Monte (SJDM) at Norzaragay sa Bulacan.
Nilabag din umano ng landfill ang Rule 14, Secretary 1 ng Republic Act 2002, o ang Philippine Ecological Solid Waste Management Act of 2000, na nagsasaad na ang lokasyon ng pasilidad ay dapat nakabatay sa overall land use plan ng LGU.
Napag-alaman ng ACAPE na hindi pala kasama ang nabanggit na landfill sa land use plan ng SJDM o maging ng Norzagaray, sa Bulacan.
Kung ang pagbabatayan naman ang Philippine Ecological Solid Waste Management Act of 2000, nakasaad na ang Sangguniang Bayan o Lungsod ng nasasakupang LGU ay dapat bumalangkas ng resolusyon na nagpapatunay sa pagtugon ng lokasyon, disenyo at criteria at standards na tatalima sa public sensitivity requirements.
Gayunman, sa kasawiang palad ay ipinunto ng ACAPE: “Wacuman failed to secure Sangguniang Bayan Resolution from its area of operation as there was no resolution passed confirming the compliance with the pertinent design criteria and standards that are necessary to proceed on the operations of landfill in the area.”
Nakasaad sa batas ng ang landfill facility ay dapat nakalagay sa lokasyon na malayo sa mga daluyan ng tubig o sapa, lawa at ilog na hindi bababa sa 50 meters ang distansya mula sa mga naturang katubigan at ang operasyon nito ay hindi dapat makaapekto sa kalikasan kasama na ang aquifers, groundwater reservoirs, o watershed areas. “The location of facility is a violation of Presidential Decree (PD) 1152 which prohibits landfills along the banks of rivers and streams. Wacuman’s facilities are adjacent to a water system which is in violation of 300 meters distance requirement under DENR Administrative Order No. 50 series of 1998,” tugon pa ng ACAPE.
Ipinunto rin ng grupo ang Supreme Court en banc decision sa MMDA, et al. vs. concerned residents of Manila Bay. G.R. Nos. 171947-48 na may petsang February 15, 2011 na nagsasaad na ang Bulacan LGUs ay obligado na protektahan ang Manila Bay sa pamamagitan ng pag-aksiyon laban sa mga factories, commercial establishments, private homes at iba pa na lumalabag sa kalikasan. “To our dismay, however, the Wacuman facility is adjacent to a water system that flows within SJDM which are direct tributaries of Angat River that flows to Angat Reservoir. The river and creeks that flow within San Jose del Monte, Bulacan, where Wacuman is situated, are direct tributaries of Angat River. Angat River flows from to the Angat Reservoir,” Ayon pa sa grupo.
Ipinaliwanag pa ng ACAPE: “Among the natural waterways of SJDM are the Kipungkok, Sto. Cristo, and Sta. Maria river systems. These rivers are connected to Marilao River, a direct tributary that flows to Manila Bay. Wacuman’s operations pollute the rivers in San Jose del Monte. Therefore, it also pollutes Marilao River that flows to Manila Bay. Manila Bay is the catch basin of several bodies of water, including Marilao River.”
Ibinunyag din ng grupo ang pag-aaral sa water condition na isinagawa ng CRL Environmental Corp. noong February 26, 2019. Ang samples ng surface water na nakolekta mula sa midstream — na hinango mula sa Bubuaya Creek at katas na nagmula sa Wacuman Sanitary Landfill — nakumpirma na nagdudulot ang landfill ng “reprehensible and unacceptable threats to health and environment.”
Ayon kay Chairman Gloria Dequito Cardona of Barangay Paradise III in SJDM, walang public consultation o public hearing na naganap nang buksan ang Wacuman facility.
Pang huli sa ipinunto ng ACAPE na ang Wacuman facility “has no title or consent from the registered owner Bangko Sentral ng Pilipinas (BSP) to conduct landfill facilities in SJDM.”
Umaasa ang ACAPE na kagyat na tutugunan nina Senator Villar, Senator Go.
