Inutusan ng Korte Suprema sila Raffy Tulfo at pitong opisyales ng pahayagang Abante Tonite na magbayad ng P1.5 milyon danyos perwisyo at mahigit P200,000 na attorney’s fee dahil sa umano’y mapanirang storya tungkol sa isang negosyante noong 2003.
“This case comes at a time when the credibility of journalists is needed more than ever; when their tried-and-tested practice of adhering to their own code of ethics becomes more necessary, so that their truth may provide a stronger bulwark against the recklessness in social media,” ayon kay Supreme Court Associate Justice Marvic Leonen sa desisyong inilabas noong Abril 10 na isinapubliko lamang ngayon.
“Respondents, then, should have been more circumspect in what they published. They are not media practitioners with a lack of social following; their words reverberate,” dagdag pa niya.
Nag-ugat ang kaso sa artikulong isinulat noon ni Raffy Tulfo kung saan inakusahan niyang pinapatigil umano ni Michael Guy, may-ari ng MG Forex Corporation, ang isinisagawang imbestigasyon ng pamahalaan sa kasong tax fraud laban sa negosyante.
Ayon kay Tulfo, matapos umanong dumulog si Guy kay noo’y Department of Finance (DOF) Secretary Juanita Amatong, inutos ng kalihim sa Revenue Integrity Protection Service (RIPS), sangay ng kagawaran na nagsisiyasat sa kaso, na isuko ang mga dokumentong konektado kay Guy.
Batay sa decision, hindi naberika ng kampo nila Tulfo ang impormasyong nakalap at hindi pasok sa huridiksyon ng RIPS si Guy dahil hindi siya kawani ng gobyerno.
Kasama ni Tulfo na magbabayad kay Guy si dating publisher Allen Macasaet, at mga editors na sila Nicolas Quijano, Jr., Janet Bay, Jesus Galang, Randy Hagos, Jeany Lacorte, and Venus Tandoc.
Magugunitang humingi noon ng dagdag na P5 milyong danyos ang negosyante pero hindi pinaburan ng korte.
