Dinipensahan ni Chief Presidential Counsel Salvador Panelo ang pahayag ni Pangulong Rodrigo Duterte na bantang aarestuhin ang mga taong tatangging magpabakuna laban sa COVID-19.
Ayon kay Panelo, mayroong constitutional duty si Pangulong Duterte na pagsilbihan at protektahan ang mga tao lalo na sa panahon ng national health emergency.
“The order of the President is not without any constitutional basis. Article II, Section 4 of our Constitution mandates that ‘The prime duty of the government is to serve and protect the people,’” sabi ni Panelo.
Giit ni Panelo ang kautusan ni Pangulong Duterte ay layuning sagipin ang buhay ng mga tao mula sa nakamamatay na epekto ng COVID-19.
“We are in a state of national emergency due to the deathly pandemic. Drastic times demand for drastic measures. The Constitution has given sufficient authority to the government to manage the crisis even as it works vigorously towards achieving herd immunity while our people look forward to reaching it,” sabi ni Panelo.
Ang pambansang seguridad ay mas nakakataas sa personal choice ng tao.
“Individual choice or liberties are to be respected but the security of the nation is paramount hence its survival must be fiercely protected,” ani Panelo.
Binanggit ni Panelo ang dalawang iba pang section ng Saligang Batas na may kinalaman sa pagprotekta sa buhay, pagsusulong ng general welfare at pagsagip sa buhay ng mga tao.
Sinabi ni Panelo na ang mga nasabing constitutional provisions ay self-executory, at hindi kailangan ng legislation para ito ay ipatupad.
