Gibabagan ni Atty. Miguel Paderanga ang Motion for Reconsideration kon MR nga gipasaka ni first district Congressman Pedro Unabia sa Comelec first Division sa Manila.
Kini pina-agi sa iyang gipasakang “OPPOSITION TO “MOTION FOR RECONSIDERATION” ni Atty. Paderanga sa Comelec first division niadtong Hunyo 21.
Sa iyang duha ka pahinang Opposition, iyang gipangayo sa Comelec first division nga i-basura ang Motion for reconsideration ni Unabia.
“WHEREFORE, it is respectfully prayed of this Honorable Commission on Elections, First Division, that the Motion for Reconsideration be denied in the interest of law & substantial justice” matud ni Atty. Paderanga.
Gibutyag ni Paderanga nga dapat ibasura gayud sa Comelec ang motion ni Unabia kay walay bag-ong rason ang maong Congressman aron iyang i-depensa ang iyang na-commit nga “Material misrepresentation” sa dihang nag-file siya sa iyang Certificate of Candidacy sa iyang paglansad sa pagka Vice Mayor sa Gingoog City niadtong May 13 elections.
Matud ni Paderanga nga wala matubag ug insakto ni Unabia ang iyang rason nga ang residency sa maong Congressman sa Purok Duterte, Barangay San Luis, Gingoog City wala pa mag-usa ka tuig.
“The arguments in the motion for reconsideration are but a rehash of those alleged in respondent’s position paper or memorandum contesting petitioner’s claim that respondent knowingly committed material misrepresentation when he declared in his COC that he is a resident of Gingoog City” matud ni Paderanga.
Lakip sa rason ni Paderanga, ngano nga dapat ibasura ang mition ni Unabia, tungod niini nga mga rason.
“The Honorable Commission on Elections, First Division, as quasi-judicial body, is the trier of facts which appropriately applied the Omnibus Elections Code, as amended, as well as its implementing IRR & the Local Government Code, as such its findings of facts are entitled to high respect & are generally sustained by the appellate courts. Thus, the Supreme Court repeatedly held:” matud ni Paderanga.
