Tinukoy sa impeachment trial na hindi rin compliant o hindi nakasunod sa Joint Circular 2015-01 ang certification para sa mga confidential activities ng Office of the Vice President (OVP) sa third quarter ng 2023.
Ang naturang certification ay inisyu ni Colonel Raymund Dante Lachica na head ng Vice Presidential Security and Protection Group (VPSPG).
Ayon kay Commission on Audit-Intelligence and Confidential Funds Audit Office (COA-ICFAO) state auditor Xylene del Campo, ang certification ay bilang suporta sa payment of rewards ng isinagawang confidential activities ng OVP.
Gayunman, ipinunto ni Del Campo na wala siyang nakitang accomplishment o naging resulta para mapatunayan ang pagbibigay ng payment of rewards gaya na lamang kung may nahuli ba na NPA sa sinasabing surveillance activities.
Batay sa Protective Intelligence Operations Reports (PIOR) na nakapaloob sa certification, ang mga confidential activities ni VP Duterte ay mga meetings, attendance sa mga commencement exercises, tree planting, courtesy visits, coordination meetings at awards ceremony na tulad sa December 2022 confidential activities ay hindi compliant sa dapat na paggamitan ng confidential funds.
Dagdag pa ni Del Campo ang mga confidential activities na ito ay pareho rin sa 1st at 2nd quarter ng 2023.
Idiniin din ni Del Campo ang paglabag ng OVP sa joint circular matapos na utusan ni VP Duterte ang kanyang special disbursing officer na si Gina Acosta na ibigay ang cash advance kay Lachica.
Nakasaad sa joint circular na hindi maaaring ibigay ng isang Special Disbursing Officer (SDO) ang cash advance sa ibang officer.
